These Terms of Service (“Terms”) govern your access to and use of the EzProofMe websites, applications, APIs, and related services (collectively, the “Service”). By using the Service, you agree to these Terms.

Important: EzProofMe is not time-tracking, not surveillance, and not a notary. EzProofMe produces a digital receipt that records certain verification signals at a point in time. It does not guarantee truth, identity beyond the provided signals, or continuous presence.

1) Who We Are

EzProofMe is a brand/project operated by EzTrust, Inc. (“EzTrust,” “we,” “us”). Contact: support@EzProofMe.com

2) Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Service. You represent that you have the legal authority to accept these Terms.

3) What the Service Does (and Does Not Do)

What it does: The Service can capture verification signals such as a selfie image, device-based biometric verification (e.g., passkey/fingerprint via your device), geolocation, and timestamps. It may generate a digital receipt that summarizes those signals.

What it does NOT do:

By checking the Terms/Privacy consent box and using the Service, you provide express written consent and authorization for EzTrust to: (a) collect and process your selfie image, (b) collect and process your precise location, (c) record timestamps, and (d) use device-based biometric verification results (as available) to generate and display your receipt.

You further agree that this consent is a written release for these purposes and is provided voluntarily. If you do not agree, do not use the Service.

5) Biometric Data Definitions & BIPA-Safe Language

The Service may involve biometric-related processing in two ways:

  1. Device-based biometric verification (e.g., fingerprint/face) performed by your device’s operating system for passkey authentication. We generally receive a success/failure verification result, not your raw biometric scan.
  2. Selfie images used as a verification signal and displayed in the receipt (and may be stored according to the retention rules below).

Where applicable, “Biometric Identifiers” and “Biometric Information” mean terms as defined under applicable biometric laws (including, where applicable, Illinois’ Biometric Information Privacy Act (“BIPA”)). The Service is designed to avoid storing raw biometric templates from device sensors. If future features introduce biometric templates, they will be covered under these Terms and the Privacy Policy.

6) Retention & Destruction Policy

We retain verification data only as long as reasonably necessary to provide the Service, comply with law, prevent abuse, and resolve disputes. Unless a longer period is required by law or for fraud/security reasons:

7) Payments

Certain features (including unlocking a receipt) require payment. Fees are shown before you pay. Payments are processed by third-party payment processors (e.g., Stripe). We do not store your full card number.

Unless required by law, fees are generally non-refundable once a receipt is unlocked, because processing and verification services are delivered immediately.

8) Acceptable Use / Prohibited High-Risk Uses

You agree not to misuse the Service. Prohibited uses include:

9) Accuracy Limits (GPS drift, spoofing, device limits)

Verification signals can be imperfect. Location can be affected by GPS drift, building interference, network conditions, device settings, or spoofing. Biometrics/passkeys rely on device security; compromised devices can produce misleading results. You agree that the receipt is a record of signals, not a guarantee of ground truth.

10) Third-Party Processors

We may use third parties to provide parts of the Service, including payment processing (e.g., Stripe), hosting/CDN, logging/monitoring, email/SMS delivery, and analytics. These processors may handle limited data on our behalf under contractual restrictions.

11) Intellectual Property

The Service, its branding, UI, code, designs, and content are owned by EzTrust or its licensors and are protected by intellectual property laws. You receive a limited, revocable license to use the Service as intended.

You retain rights to your content (e.g., your selfie), but you grant us a limited license to process it to provide the Service and generate receipts.

12) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No reliance: Receipts are informational records of verification signals and should not be the sole basis for legal, financial, medical, or safety decisions.

If we later add automated/AI features, you agree that such features may be probabilistic and can make mistakes; final responsibility remains with the user.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EZTRUST WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS/REVENUE, DATA LOSS, OR BUSINESS INTERRUPTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO EZTRUST FOR THE SERVICE IN THE 30 DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR $50, IF GREATER), UNLESS LAW REQUIRES OTHERWISE.

14) Indemnification

You agree to defend, indemnify, and hold harmless EzTrust and its officers, directors, employees, and agents from claims, damages, losses, and expenses arising from your use of the Service, your content, or your violation of these Terms or applicable law.

15) Force Majeure

We are not responsible for delays or failures due to events beyond our reasonable control, including outages, natural disasters, war, terrorism, labor disputes, internet/service-provider failures, or governmental actions.

16) Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or for security/fraud reasons. Certain sections (including payment obligations, disclaimers, limitation of liability, indemnity, and dispute provisions) survive termination.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Where consumer protection laws apply, some provisions may be limited to the extent required by law.

Class Action Waiver: To the extent permitted by law, you agree to bring claims only in your individual capacity and not as a plaintiff or class member in any purported class action.

Arbitration note: arbitration enforceability can vary by jurisdiction (especially for consumers in Canada). We can add a tailored arbitration clause later if you want.
